Immunity from Seizure
The Australian Government has conducted public consultation on the potential introduction of immunity from seizure legislation in Australia.
It explored this issue to gain a wider perspective on the impact a lack of this type of legislation is having, or is likely to have, in the Australian context.
Submissions closed on 28 August 2011.
The discussion paper outlined the key issues involved in the consideration of immunity from seizure and offered a series of questions to guide preparation of submissions.
The discussion paper posed a hypothetical model of possible legislation designed to attract comments. The model refers to Australian Protected Objects, as established by the Commonwealth Protection of Movable Cultural Heritage Act 1986. The section of the Regulations which sets out what objects are classified as Australian Protected objects can be downloaded here:
